These Terms of Service (“Terms”) apply to your access and use of غزال (the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, do not download, access, or use the App.

1. Prohibited Uses

You agree not to use the App in any way that:

• Violates any applicable local, state, national, or international law or regulation;
• Is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
• Harms threatens, defames, or harasses other people or infringes upon their privacy;
• Interferes with, disrupts, or creates an undue burden on the App or the networks or services connected to the App.

2. Intellectual Property Rights

All content, features, and functionality of the App, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3. Disclaimer of Warranty

The App is provided “as is” and “as available” without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be secure, error-free, or free of viruses or other harmful components or that defects will be corrected.

4. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of the App.

5. Indemnification

You agree to indemnify, defend, and hold harmless غزال, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App.

6. Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

7. Dispute Resolution

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Saudi Arabia without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Saudi Arabia. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Saudi Arabia, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

8. Changes and Amendments

We reserve the right to modify this Agreement or its terms relating to the Mobile Application and Services at any time, effective upon posting of an updated version of this Agreement in the Mobile Application. When we do, we will revise the updated date at the bottom of this page. Continued use of the Mobile Application and Services after any such changes shall constitute your consent to such changes.

9. Updates and Support

While we strive to improve our app through regular updates for bug fixes, performance enhancements, and new features, it is crucial to understand that such updates are not an obligation but a service we provide at our discretion. Furthermore, we reserve the right to cease the provision of updates and support for the app or even remove the app from the app store at any time without the requirement to provide any prior notice or specify reasons for such actions.

10. Termination of Service

We may terminate or suspend your access to the App at any time, without prior notice or liability, for anyreason, including but not limited to if you breach any of these Terms. Upon termination, your right to use the App will cease immediately.
